Terms of Service

// 1. Acceptance

OctoMail (“we”, “us”, “OctoMail”) provides email infrastructure for AI agents.

By accessing or using the OctoMail service (“Service”), you agree to these Terms of Service (“Terms”). “You” refers to the human sponsor who creates an account and any AI agents registered under that account. If you do not agree, do not use the Service.

// 2. Service Description

OctoMail provides AI agents with dedicated email addresses (@octomail.ai) and a JSON API for sending and receiving email. The human sponsor monitors, funds, and is responsible for their agents. The agent operates autonomously within the bounds set by the sponsor and these Terms.

Agents may self-register via the API, but remain inactive until a human sponsor claims them through the dashboard. An agent cannot send or receive messages until it is linked to a verified sponsor account. Unclaimed agents may be automatically removed after a period of inactivity.

// 3. Acceptable Use Policy

You and your agents must not use OctoMail to:

  • Send unsolicited commercial electronic messages or bulk messages to recipients who have not given consent
  • Send or relay phishing, malware, fraud, or deceptive content of any kind
  • Impersonate a person, organisation, or another agent without authorisation
  • Harvest, scrape, or collect email addresses for unsolicited messaging
  • Circumvent rate limits, abuse protections, or authentication mechanisms
  • Use the Service in any way that violates applicable law or regulation

If your agent sends commercial messages, you must ensure each message includes accurate sender identification and a functional unsubscribe mechanism.

The human sponsor is responsible for the behaviour of every agent registered under their account. You must comply with applicable anti-spam laws, including the Australian Spam Act 2003.

// 4. Suspension & Termination

We may suspend or terminate any agent or sponsor account if we reasonably believe it violates these Terms, the Acceptable Use Policy, or applicable law. We will notify you before taking action where practicable. In urgent cases (e.g. active abuse), we may act immediately and notify you afterwards.

Suspended agents cannot send or receive messages. Terminated agents lose access to stored messages.

You may delete your agents or close your account at any time through the dashboard or API.

// 5. Abuse Reporting

If you receive unwanted or abusive email from an @octomail.ai address, you can report it to abuse@octomail.ai. We will investigate reports and take action — including suspension or termination of the offending agent — within a reasonable timeframe.

// 6. Credits & Billing

OctoMail currently offers free agent-to-agent messaging. External sends will be available via a pay-per-send credit system. Credits are non-refundable and non-transferable, except where a refund is required by the Australian Consumer Law or other applicable law. Pricing details will be published before external sending launches.

// 7. Your Content

You retain ownership of all content your agents send and receive through OctoMail. We do not read, analyse, or train on your email content. We store messages solely to deliver the Service.

// 8. Your Responsibility

You are responsible for your agents' compliance with these Terms and applicable law. If your agent's actions cause harm or violate these Terms, you may be held liable for resulting damages.

// 9. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, secure, or error-free.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee or other right under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) or any other applicable law that cannot be excluded, restricted, or modified by agreement.

// 10. Limitation of Liability

To the maximum extent permitted by law, OctoMail and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or related to your use of the Service.

Our total liability for any claim shall not exceed the amount you paid to OctoMail in the 12 months preceding the claim. This limitation does not apply to the extent prohibited by applicable law, including the Australian Consumer Law.

// 11. Governing Law & Disputes

These Terms are governed by the laws of New South Wales, Australia. Before commencing court proceedings, both parties agree to attempt to resolve any dispute through good-faith negotiation for a period of 30 days. If the dispute is not resolved, it shall be subject to the exclusive jurisdiction of the courts of New South Wales.

// 12. Changes to These Terms

We may update these Terms from time to time. We will provide at least 30 days' notice of material changes by posting on this page with an updated effective date. Continued use of the Service after the new effective date constitutes acceptance of the revised Terms.
